font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">第一條<span lang="EN-US"> </span>為了規范物業管理活動,提升物業服務水平,維護業主、物業使用人和物業服務企業的合法權益,營造良好的居住和工作環境,根據《中華人民共和國物權法》、國務院《物業管理條例》和有關法律、行政法規,結合本省實際,制定本條例。</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 31.2pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">第二條<span lang="EN-US"> </span>本條例適用于本省行政區域內物業管理活動及其監督管理。</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;" lang="EN-US">    </span><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">本條例所稱物業管理,是指業主通過選聘物業服務企業,由業主和物業服務企業按照物業服務合同約定對建筑物、構筑物及配套的設施設備和相關場地進行維修、養護、管理,維護物業管理區域內的環境衛生和相關秩序的活動。</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 31.2pt; line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">第三條<span lang="EN-US"> </span>物業管理應當遵循業主自治、專業服務與依法監管相結合的原則。</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 30.55pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">第四條<span lang="EN-US"> </span><span style="letter-spacing: -.2pt;">縣級以上人民政府應當將物業服務納入現代服務業發展規劃、社區建設和社區治理體系,建立和完善專業化、社會化、市場化的物業管理機制。鼓勵采用新技術、新方法,提高物業管理和服務水平。</span></span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 30.55pt; line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">第五條<span lang="EN-US"> </span>縣級以上人民政府住房和城鄉建設或者房地產行政主管部門(以下簡稱物業管理行政主管部門)負責本行政區域內物業管理活動的監督管理工作,履行以下職責:</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(一)擬定、制定和宣傳物業管理相關政策措施;</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(二)依照職權制定物業服務質量標準和技術規范;</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 31.2pt; line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(三)指導街道辦事處、鄉鎮人民政府依法開展物業管理相關工作;</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(四)指導、監督和管理物業管理招投標活動;</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(五)監督、管理專項維修資金;</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(六)建立物業管理誠信檔案制度;</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(七)法律、法規規定的其他職責。</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 31.2pt; line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">縣級以上人民政府發展改革、公安、司法、民政、財政、環保、城鄉規劃、城市管理、工商、價格、質監、人防等部門,應當按照各自的職責,相互配合,做好相關監督管理工作。</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 31.2pt; line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">第六條<span lang="EN-US"> </span>街道辦事處、鄉鎮人民政府履行以下職責:</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 31.2pt; line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(一)指導和協助業主大會的成立、業主委員會的選舉;</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 31.2pt; line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(二)指導和監督業主大會、業主委員會開展工作;</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 31.2pt; line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(三)協調物業管理與社區管理、社區服務之間關系,調處業主、業主委員會、物業使用人、物業服務企業在物業管理活動中的糾紛;</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 31.2pt; line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(四)協調和監督物業服務企業的交接;</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 31.2pt; line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(五)協調和監督老舊小區物業管理。</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 31.2pt; line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">居民委員會、村民委員會應當予以協助和配合。</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 31.2pt; line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">第七條<span lang="EN-US"> </span>物業管理協會應當加強行業自律,規范行業經營行為,促進物業服務企業提高服務質量和水平。</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-align: center; line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">第八條<span lang="EN-US"> </span>房屋所有權人為業主。</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 31.2pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">業主身份的確認,以不動產登記簿或者法律、行政法規規定的其他有效證明為依據。</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 31.2pt; line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">第九條<span lang="EN-US"> </span>業主在物業管理活動中享有以下權利:</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;" lang="EN-US">    </span><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(一)提議召開業主大會會議,參加業主大會會議,提出制定和修改管理規約、業主大會議事規則的建議;</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;" lang="EN-US">    </span><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(二)向業主委員會和物業服務企業提出建議或者質詢;</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;" lang="EN-US">    </span><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(三)推選業主代表,并享有被推選權;</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;" lang="EN-US">    </span><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(一)遵守管理規約、業主大會議事規則,執行業主大會的決定和業主大會授權業主委員會作出的決定;</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 31.2pt; line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(二)遵守物業管理區域內物業共用部位和共用設施設備的使用、公共秩序和環境衛生的維護等方面的規章制度;</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 31.5pt; line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(三)按照國家有關規定交納專項維修資金;</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 31.5pt; line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(四)按照物業服務合同約定交納物業服務費用;</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 31.2pt; line-height: 28pt; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;"><span style="font-size: 12.0pt; font-family: 宋體; mso-bidi-font-family: 宋體; color: #333333; mso-font-kerning: 0pt;">(四)住宅小區內的非住宅物業應當與住宅小區劃分為同一個物業管理區域;商貿、辦公、醫院、學校、工廠、倉儲等非住宅物業及單幢商住樓宇具有獨立共用設施設備,并能夠獨立管理的,可以劃分為一個物業管理區域。</span></p> <p class="d3d3zg9uz3plc3ljb20 MsoNormal" style="text-indent: 31.2pt;
